How to Permit a Quarry in Florida
The agencies, the order of permits, and the local approvals that decide whether a Florida quarry or sand pit gets built.
Florida mines limerock, sand, and shell in flat, wet, karst country. Water decides almost everything: wetlands, aquifer drawdown, and dewatering volumes. Expect the Environmental Resource Permit and the county land-use approval to set your schedule.
Who regulates a quarry in Florida
| Agency | What it controls |
|---|---|
| FDEP Mining and Mitigation Program | Reclamation of non-phosphate mines (limerock, sand, clay, shell) under Chapter 378, Part IV, F.S., and Rule 62C-36, F.A.C., plus Environmental Resource Permits for mines. |
| Water management district | Water-use permits for dewatering, washing, and wells. The district can also be the ERP agency in some cases. |
| FDEP | NPDES for discharges and air permits for crushing plants. |
| FWC | Gopher tortoise relocation permits and other state-listed species reviews. |
| County | Comprehensive plan designation and a rezoning, special exception, or mining-specific permit under the land development code. |
The permit path, in order
01Land-use designation
Check the future land-use map first. A comprehensive-plan amendment adds months and a state review.
02Wetland delineation and ERP
Delineate wetlands, design avoidance and mitigation, and file the Environmental Resource Permit. This usually runs together with the Corps Section 404 permit.
03Reclamation plan
File the reclamation program with FDEP: final slopes, littoral shelves around pit lakes, and revegetation.
04Water use
Model drawdown and apply for the water-use permit for dewatering and the wash plant.
05Species and county hearing
Complete gopher tortoise surveys and relocation, then take the county approval to hearing.
Where Florida projects get stuck
Dewatering
Large drawdown cones near wells, lakes, or springs bring heavy conditions or a lower pit floor. Model it before you buy.
Mitigation cost
Wetland mitigation credits can cost more than the land. Price them in the screen, not after the deal.
Pit-lake end use
Counties increasingly ask what the lake becomes. A credible end use, such as a residential lake or a water-supply reservoir, helps at hearing.
The local fight
Florida counties hold real power through the comprehensive plan. Neighbors focus on trucks, blasting near homes on soft karst, and water levels in their wells and lakes. Show a haul route that avoids schools, a drawdown model, and a monitoring plan.
The federal layer (every state)
| Item | When it applies |
|---|---|
| MSHA Mine ID | Every mine. File a Legal Identity Report with MSHA before you start, and have Part 46 or Part 48 training in place on day one. |
| Section 404 | Any fill in wetlands or other waters of the US needs a US Army Corps of Engineers permit. Delineate wetlands early. |
| Endangered species | Federal permits trigger ESA consultation. Listed species on the site can redraw the pit. |
| SPCC plan | Fuel storage above 1,320 gallons of aboveground capacity needs a Spill Prevention, Control, and Countermeasure plan. |
| Crusher air rules | Crushing and screening plants fall under EPA NSPS Subpart OOO. The state air agency issues the permit. |
