How to Permit a Quarry in Georgia
The agencies, the order of permits, and the local approvals that decide whether a Georgia quarry or sand pit gets built.
Georgia runs one statewide surface mining permit for most minerals, but it ties that permit to local land use. A project that does not fit local zoning will not get far, so the county and the state permit move together.
Who regulates a quarry in Georgia
| Agency | What it controls |
|---|---|
| Georgia EPD, Surface Mining Unit | Permits under the Georgia Surface Mining Act of 1968: application, Surface Mining Land Use Plan, bond, and reclamation inspections. |
| Georgia EPD (water and air) | NPDES coverage for discharges and stormwater, water withdrawal permits, and air permits for crushing plants. |
| Georgia DNR Wildlife Resources | State-protected species review when it applies. |
| County or city | Zoning and any special-use permit. The state mining application expects the land use to fit local zoning. |
The permit path, in order
01Zoning first
Confirm or secure zoning for mining. A rezoning or special-use permit with public hearings is often the longest step.
02Surface Mining Land Use Plan
Prepare the mining and reclamation plan, maps, and post-mining land use.
03State mining permit and bond
File with the EPD Surface Mining Unit and post the reclamation bond.
04Water and air
Secure NPDES coverage, any water withdrawal permit, and the crusher air permit.
05MSHA and start-up
Get the Mine ID, set up training, and schedule the pre-operational items.
Where Georgia projects get stuck
Granite near metro Atlanta
The best granite is close to the market and close to subdivisions. Blasting vibration and dust dominate hearings.
Coastal plain sand
Sand and kaolin districts raise wetland and stream-buffer issues. State stream buffers apply to many waters.
Repeat applications
Counties remember past denials. A withdrawn application often comes back with a smaller footprint and bigger buffers.
The local fight
Georgia hearings are won on buffers, truck routes, and blast monitoring. Organized opposition groups form fast once signs go up. Meet the closest neighbors before the application is public.
The federal layer (every state)
| Item | When it applies |
|---|---|
| MSHA Mine ID | Every mine. File a Legal Identity Report with MSHA before you start, and have Part 46 or Part 48 training in place on day one. |
| Section 404 | Any fill in wetlands or other waters of the US needs a US Army Corps of Engineers permit. Delineate wetlands early. |
| Endangered species | Federal permits trigger ESA consultation. Listed species on the site can redraw the pit. |
| SPCC plan | Fuel storage above 1,320 gallons of aboveground capacity needs a Spill Prevention, Control, and Countermeasure plan. |
| Crusher air rules | Crushing and screening plants fall under EPA NSPS Subpart OOO. The state air agency issues the permit. |
