How to Permit a Quarry in North Carolina

PERMIT GUIDE · NORTH CAROLINA · OCT 2026

The agencies, the order of permits, and the local approvals that decide whether a North Carolina quarry or sand pit gets built.

North Carolina requires a state mining permit for most mines that disturb one acre or more. The state process includes notice to neighbors and to the local government, so the community learns about the project early.

Who regulates a quarry in North Carolina

AgencyWhat it controls
NC DEQ, Division of Energy, Mineral, and Land ResourcesMining permits under the Mining Act of 1971: application, reclamation plan, bond, notice, and inspections.
NC DEQ (water and air)NPDES coverage for mine dewatering and stormwater, and air permits for crushing plants.
NC Wildlife Resources CommissionComments on species and habitat during permit review.
County or cityZoning and any special-use permit. Local governments receive notice of the application.

The permit path, in order

01Pre-application meeting

Meet with DEMLR mining staff to confirm the permit boundary and what the review will focus on.

02Notice

Notify adjoining landowners and the local government as the application requires. Expect requests for a public hearing.

03Mining permit and bond

File the application, maps, and reclamation plan, and post the bond.

04Water and air

Obtain NPDES coverage for mining discharges and stormwater, and the crusher air permit.

05Local approvals

Secure the zoning or special-use permit, then MSHA registration and start-up.

Where North Carolina projects get stuck

Hearings

Public hearings on mining permits are common in growing counties. Prepare exhibits for noise, dust, traffic, and groundwater.

Buffers

Undisturbed buffers along property lines and streams shrink the mineable area. Draw them before you value the site.

Groundwater

Crystalline-rock aquifers feed private wells. A pre-blast well survey is the cheapest goodwill you can buy.

The local fight

North Carolina growth corridors put quarries next to new subdivisions. Neighbors often attend both the state hearing and the county hearing. Use one consistent set of facts in both rooms.

The federal layer (every state)

ItemWhen it applies
MSHA Mine IDEvery mine. File a Legal Identity Report with MSHA before you start, and have Part 46 or Part 48 training in place on day one.
Section 404Any fill in wetlands or other waters of the US needs a US Army Corps of Engineers permit. Delineate wetlands early.
Endangered speciesFederal permits trigger ESA consultation. Listed species on the site can redraw the pit.
SPCC planFuel storage above 1,320 gallons of aboveground capacity needs a Spill Prevention, Control, and Countermeasure plan.
Crusher air rulesCrushing and screening plants fall under EPA NSPS Subpart OOO. The state air agency issues the permit.
