How to Permit a Quarry in Oklahoma

PERMIT GUIDE · OKLAHOMA · OCT 2026

The agencies, the order of permits, and the local approvals that decide whether a Oklahoma quarry or sand pit gets built.

Oklahoma is a major crushed stone state with a dedicated mining agency. Most rural areas have light local land-use control, so the state permit and water rights carry most of the weight.

Who regulates a quarry in Oklahoma

AgencyWhat it controls
Oklahoma Department of MinesNon-coal mining permits and reclamation: application, reclamation plan, bond, and inspections.
Oklahoma DEQStormwater and discharge permits, and air permits for crushing plants.
Oklahoma Water Resources BoardPermits to use groundwater or stream water for dewatering, dust control, and washing.
CountyRoad-use agreements and any zoning. Many rural counties have limited zoning.

The permit path, in order

01Mining permit

File the non-coal mining permit with the Department of Mines and post the bond.

02Water rights

Apply to OWRB for the water you will use. Washing plants need a reliable supply.

03DEQ permits

Secure stormwater and discharge coverage and the crusher air permit.

04Roads

Agree on haul routes and road maintenance with the county.

05MSHA and start-up

Get the Mine ID and training plan in place before the first shot.

Where Oklahoma projects get stuck

Granite and limestone districts

The Arbuckle and Wichita Mountains areas hold high-quality stone, and also scenic, tourism, and aquifer concerns that draw attention.

Aquifers

The Arbuckle-Simpson aquifer has special water-management limits. Check the water source before you size a wash plant.

Long hauls

Many Oklahoma quarries ship by rail to Texas markets. Rail access can matter more than the local market.

The local fight

With little zoning, opposition shows up at the Department of Mines permit stage and at county road decisions. A clear blasting and traffic plan does more than a large public-relations budget.

The federal layer (every state)

ItemWhen it applies
MSHA Mine IDEvery mine. File a Legal Identity Report with MSHA before you start, and have Part 46 or Part 48 training in place on day one.
Section 404Any fill in wetlands or other waters of the US needs a US Army Corps of Engineers permit. Delineate wetlands early.
Endangered speciesFederal permits trigger ESA consultation. Listed species on the site can redraw the pit.
SPCC planFuel storage above 1,320 gallons of aboveground capacity needs a Spill Prevention, Control, and Countermeasure plan.
Crusher air rulesCrushing and screening plants fall under EPA NSPS Subpart OOO. The state air agency issues the permit.
