STATE GUIDES · OCT 2026

How to permit a quarry or sand pit, state by state: who regulates, the order of permits, and where projects get stuck.

Every quarry, rock pit, and sand mine needs a stack of approvals: a state mining or reclamation permit, water and air permits, local land use, and federal items such as an MSHA Mine ID. The order matters, and the local hearing usually decides the schedule. Pick a state.

The four gates every project passes

01Land use

Zoning, special use, or a comprehensive-plan amendment. This is usually the longest and least predictable step.

02Mining and reclamation

The state mining permit, reclamation plan, and bond, where the state requires one.

03Water and air

NPDES or state-equivalent discharge and stormwater permits, water-use permits, and the crusher air permit.

04Federal and start-up

Corps Section 404 if wetlands are filled, species consultation, SPCC for fuel, and the MSHA Mine ID and training plan.

The federal layer (every state)

ItemWhen it applies
MSHA Mine IDEvery mine. File a Legal Identity Report with MSHA before you start, and have Part 46 or Part 48 training in place on day one.
Section 404Any fill in wetlands or other waters of the US needs a US Army Corps of Engineers permit. Delineate wetlands early.
Endangered speciesFederal permits trigger ESA consultation. Listed species on the site can redraw the pit.
SPCC planFuel storage above 1,320 gallons of aboveground capacity needs a Spill Prevention, Control, and Countermeasure plan.
Crusher air rulesCrushing and screening plants fall under EPA NSPS Subpart OOO. The state air agency issues the permit.

Do not start the clock until you know the path.
A permit-path plan costs less than one month of delay. We map every approval, its order, and its risk.
